Mr. Mertz has extensive experience representing developers, builders, investors, and owner-occupiers in all stages of commercial real estate purchase and sale transactions including negotiating, examining, and preparing letters of intent, purchase and sale contracts, due diligence inquiry, land title review-objection-response, easements, cross-easements, covenants, conditions, estoppel certificates, subordination nondisturbance and attornment agreements, intergovernmental agreements, closings (including stages of IRC §1031 real property tax deferred like kind exchanges), escrow, and follow-through.
The firm’s representation extends to both owners and lessees in commercial ground leases, triple-net single-tenant property leases, retail shopping center and outparcel leases, build to suit leases, parking lot leases, office, restaurant, medical, and warehouse leases, industrial leases, and cellular communication tower leases, subleases, PSAs and assignments.
The firm also organizes and establishes commercial condominium regimes and owners’ associations.
Mr. Mertz is ordinarily successful in resolving legal disputes without having to resort to litigation. On the rare occasion a lawsuit must be filed or defended, Andrew is able to associate one of the several excellent litigators with whom he has worked over the years. Mr. Mertz also serves as a special master and an expert witness in court proceedings involving land boundary lines, ownership, and lien priority.
